Iowa passed the Iowa Consumer Data Protection Act (“ICDPA”), which will take effect on January 1, 2025. With the passing of this new law, Iowa becomes the most recent state to enact a consumer data privacy law.
The ICDPA does not contain a revenue threshold and only applies to entities conducting business in Iowa or producing products or services targeted to Iowa residents that also do at least one of the following during a calendar year: (a) control or process personal data of at least 100,000 Iowa residents; or (b) control or process personal data of at least 25,000 Iowa residents and derive over 50 percent of gross revenue from the sale of personal data. It does not cover consumers acting in a commercial or employment context.
